Welcome to Kili Trails Tours & Safaris Ltd.
These Terms of Service (“Terms”) establish the terms and conditions under which Kili Trails Tours & Safaris Ltd (“Kili Trails”, “we”, “us” or “our”) provides tours, safaris, travel planning and related tourism services to our clients (“you”, “your” or “traveller”).
Our objective is to make every journey well planned, transparent, comfortable, safe and memorable.
By requesting a quotation, confirming a booking, making a payment, accepting an itinerary, or using our services, you acknowledge that you have read, understood and agreed to these Terms.

Kili Trails Tours & Safaris Ltd is a Kenya-based tours and travel company providing travel and tourism services in Kenya and across East Africa.
Our services may include:
- Tours and safaris
- Nature and wildlife safaris
- Travel planning and coordination
- Hotel and accommodation bookings
- Airport transfers
- Professional tour-guide services
- Transportation arrangements
- Visits to major tourist attractions
- Visits to historical and cultural sites
- Other related travel and tourism services
Kili Trails aims to work with reputable accommodation providers, transport providers, guides, activity operators and other tourism partners to deliver quality travel experiences.
Where a service requires a licensed or regulated third-party provider, we seek to engage appropriately qualified and authorized providers.

We believe that a good travel experience begins long before the traveller reaches the destination.
Kili Trails therefore seeks to provide:

We aim to provide clients with clear information about itineraries, inclusions, exclusions, pricing, payment requirements and important travel conditions before a booking is confirmed.
> Thoughtful planning
We take into consideration your travel dates, interests, group size, preferred pace, accommodation preferences, budget and other reasonable requirements when designing an itinerary.
> Reliable coordination
We coordinate the different elements of your trip, including accommodation, transportation, guides and activities, according to the agreed itinerary.
> Professional service
We seek to work with competent staff, guides, drivers and service providers and to maintain professional standards throughout the client journey.
> Responsible travel
We encourage travel that respects wildlife, nature, local communities, cultures, heritage and the destinations we visit.
TRA’s tourism quality framework places emphasis on customer satisfaction, personalized experiences, responsiveness and sustainable and responsible tourism practices.

Definitions
For purposes of these Terms:
“Booking” means a confirmed arrangement for one or more travel services provided or coordinated by Kili Trails.
“Client” or “Traveller” means the person or persons purchasing or using our services.
“Itinerary” means the proposed or confirmed schedule of travel services provided to the client.
“Services” means tours, safaris, accommodation, transportation, airport transfers, guides and other travel services arranged by Kili Trails.
“Supplier” means a third-party provider involved in delivering a travel component, including hotels, lodges, camps, transport companies, airlines, guides, parks, activity operators and other tourism service providers.
“Booking Confirmation” means the written confirmation issued by Kili Trails setting out the agreed travel arrangements and applicable payment requirements.

Making an Enquiry
A travel enquiry does not constitute a confirmed booking.
When you contact us, we may ask for information such as:
- Travel dates
- Number of travellers
- Destination preferences
- Accommodation preferences
- Activities of interest
- Budget range
- Dietary requirements
- Accessibility requirements
- Transport requirements
- Special requests
We use this information to understand your requirements and prepare an appropriate proposal or quotation.
A quotation remains subject to availability and is not a guarantee that the stated services will remain available until a booking is confirmed.

Itineraries and Travel Proposals
We aim to design itineraries that are practical, realistic and appropriate for the traveller’s requirements.
A proposed itinerary may include:
- Destinations
- Activities
- Travel times
- Accommodation
- Transportation
- Meals
- Park or attraction visits
- Guide services
- Airport transfers
- Other agreed services
Where practical, we will indicate what is included and excluded.
Travel times and activity schedules may be approximate because road conditions, weather, wildlife movements, traffic, park regulations, operational conditions and other circumstances may affect actual timings.
A final itinerary may therefore differ from an initial proposal where changes are necessary to improve safety, availability or operational feasibility.

Quotations and Prices
Unless expressly stated otherwise, quotations are based on the information available to us at the time the quotation is prepared.
Prices may depend on:
- Number of travellers
- Travel dates
- Accommodation category
- Room configuration
- Transport requirements
- Park and conservation fees
- Activities
- Guide requirements
- Currency exchange rates
- Supplier prices
- Government taxes, levies or fees
- Other destination-related charges
Unless specifically stated, a quotation does not constitute a guarantee of price or availability.
We will clearly communicate material changes to the quoted price before requesting confirmation of a revised booking.

What Is Included and Excluded
Each confirmed booking will specify the services included in the agreed price.
Depending on the package, inclusions may include:
- Accommodation
- Transportation
- Driver/guide services
- Airport transfers
- Meals
- Park or attraction entry fees
- Selected activities
- Other services specifically identified in the itinerary
Unless expressly included, clients should not assume that the price covers:
- International flights
- Visas
- Travel insurance
- Personal expenses
- Alcoholic beverages
- Laundry
- Telephone or internet charges
- Tips and gratuities
- Personal shopping
- Medical expenses
- Vaccinations
- Additional activities
- Optional excursions
- Expenses resulting from personal changes to the itinerary
- Costs arising from missed flights or other personal travel disruptions
The exact inclusions and exclusions applicable to your trip will be stated in your quotation or booking confirmation.

Booking Confirmation
A booking becomes confirmed when:
- The client has accepted the relevant quotation or itinerary;
- The required deposit or payment has been received; and
- Kili Trails has issued written confirmation of the booking.
Where applicable, suppliers may impose their own booking deadlines and payment conditions.
A booking should not be considered confirmed merely because an enquiry, quotation or provisional itinerary has been issued.
A booking becomes confirmed only once all three conditions are met:
- Acceptance of the quotation or itinerary
- Required deposit or payment received
- Written confirmation issued by Kili Trails

Bookings & Payments

Deposits and Payments
The deposit and payment schedule will be communicated to you before your booking is confirmed.
Depending on the nature and timing of the trip, Kili Trails may require:
- A deposit to secure the booking;
- Interim payments;
- Full payment before departure; or
- Full payment for services with strict supplier payment deadlines.
The applicable payment requirements will be stated in your booking confirmation or invoice.
Your Payment Security Matters
Clients should make payments only through payment channels officially communicated by Kili Trails.
- Payment-card PINs
- Online banking passwords
- Mobile-money PINs
- Other confidential authentication credentials
We will never intentionally request clients to disclose the above. Please verify payment instructions if you receive unexpected changes to previously provided payment details.

Payment Deadlines
Payments must be received by the deadlines stated in the booking confirmation.
Failure to make a required payment by the applicable deadline may result in:
- Loss of reserved accommodation;
- Cancellation of transport arrangements;
- Cancellation of activities;
- Changes in pricing;
- Loss of availability; or
- Cancellation of the booking.
Where a supplier imposes a non-refundable payment deadline, the relevant consequences may apply to the client’s booking.
We will make reasonable efforts to communicate payment deadlines clearly.

Cancellation by the Client
Clients may request cancellation of a booking at any time.
Cancellation charges will depend on:
- How far in advance the cancellation is made;
- The terms applicable to the relevant suppliers;
- Whether accommodation has been paid for;
- Whether transport has been reserved;
- Whether park or attraction fees have been purchased;
- Whether flights or other third-party services are involved; and
- Whether any amounts are non-refundable.
Any applicable cancellation charges will be communicated as clearly as reasonably possible.
Where a supplier has already charged Kili Trails a non-refundable amount, that amount may be deducted from any refund due to the client.

Refunds
Where a refund is due, Kili Trails will process it in accordance with the applicable booking terms and supplier policies.
Refunds may be affected by:
- Supplier cancellation policies;
- Non-refundable accommodation;
- Park or conservation fees;
- Banking or payment-processing charges;
- Currency fluctuations;
- Third-party booking conditions; and
- Other costs already incurred on behalf of the client.
Where a supplier has not yet refunded funds to Kili Trails, the timing of the client’s refund may depend on the supplier’s processing time.
We will keep the client informed where a refund is delayed because we are awaiting funds from a supplier.

Changes Requested by the Client
Clients may request changes to a confirmed itinerary.
Examples include:
- Changing travel dates;
- Changing accommodation;
- Adding activities;
- Removing activities;
- Changing room arrangements;
- Changing transportation arrangements;
- Changing the number of travellers.
We will make reasonable efforts to accommodate requested changes, subject to availability.
Additional charges may apply where a change results in increased supplier costs, cancellation fees, rebooking fees or other expenses.

Changes by Kili Trails
Travel arrangements can sometimes be affected by circumstances outside our reasonable control.
Where necessary, Kili Trails may make reasonable changes to an itinerary because of:
- Weather;
- Road conditions;
- Safety considerations;
- Wildlife conditions;
- Government restrictions;
- Park regulations;
- Supplier availability;
- Accommodation operational issues;
- Transport problems;
- Natural events;
- Security conditions;
- Changes in conservation or destination-management requirements; or
- Other circumstances affecting the safe or practical operation of the trip.
Where a material change is necessary, we will communicate it to the client as soon as reasonably practicable and, where possible, offer a suitable alternative.
Our objective will always be to preserve the overall quality and purpose of the trip while prioritizing safety and practical delivery.

Substitution of Suppliers
Kili Trails may sometimes need to substitute a hotel, lodge, camp, vehicle, guide, activity provider or other supplier.
Where this becomes necessary, we will seek to provide an alternative of a comparable standard and, where reasonably possible, in the same destination or area.
If the replacement represents a material downgrade or material change in the services purchased, we will communicate the change and address any applicable price difference fairly.
CHAPTER 03
Travel Services
Sections 16–25

Accommodation
Accommodation is subject to availability and the terms imposed by the relevant accommodation provider.
Hotel, lodge and camp facilities may differ according to:
- Location
- Room category
- Season
- Property standards
- Local conditions
- Available amenities
Room photographs and descriptions may be provided by the accommodation provider and may not always represent every individual room.
Specific room requests, including connecting rooms, particular views, bed configurations or special locations, are requests rather than guarantees unless expressly confirmed in writing.

Transportation
Transportation arrangements will depend on the agreed itinerary.
Vehicles may include appropriate safari vehicles, tourist vehicles, vans, buses or other suitable transportation depending on the trip.
Travel times are estimates and may be affected by:
- Traffic;
- Road conditions;
- Weather;
- Road works;
- Border procedures;
- Security requirements;
- Vehicle conditions;
- Park conditions; and
- Other unforeseen circumstances.
Clients are expected to follow reasonable safety instructions provided by drivers and guides.

Airport Transfers
Airport transfer times should be provided to Kili Trails accurately.
Clients should provide:
- Flight number;
- Arrival or departure date;
- Arrival or departure time;
- Airport;
- Passenger name;
- Contact details; and
- Any relevant special requirements.
Clients should notify Kili Trails promptly if flight schedules change.
We cannot guarantee that a transfer can be provided correctly where inaccurate or incomplete flight information has been supplied.

Professional Tour Guides
Kili Trails aims to provide knowledgeable and professional guides appropriate to the nature of the trip.
Guides may provide information about:
- Wildlife
- Nature
- Culture
- History
- Geography
- Local communities
- Conservation
- Destinations
- Attractions
Guide assignments may occasionally change because of illness, availability, operational requirements or other circumstances.
Where a change is necessary, we will seek to provide a suitable replacement.

Wildlife and Nature Safaris
Wildlife experiences are inherently unpredictable.
Kili Trails cannot guarantee sightings of particular animals, birds or natural events.
Wildlife movements are influenced by:
- Weather;
- Season;
- Food availability;
- Water availability;
- Animal behaviour;
- Conservation conditions; and
- Other natural factors.
Our guides will use their knowledge and experience to maximize opportunities for meaningful wildlife encounters while respecting applicable park, conservation and safety rules.
Wildlife sightings can never be guaranteed — but our guides know how to give every safari its best chance.

National Parks, Reserves and Attractions
Access to national parks, reserves, conservancies and other attractions may be subject to rules established by the relevant authority or operator.
Clients must comply with applicable rules concerning:
- Entry;
- Wildlife;
- Photography;
- Vehicle movement;
- Walking;
- Waste disposal;
- Interaction with animals;
- Cultural sites; and
- Other destination requirements.
Park, conservation and attraction fees may change without prior notice from the relevant authority. Where such changes occur, the additional cost may be payable by the client where applicable.

Passports, Visas and Travel Documents
Clients are responsible for ensuring that they possess valid travel documents appropriate to their journey.
Depending on the destination, this may include:
- Passport;
- Visa;
- Entry permit;
- Residence permit;
- Travel authorization;
- Vaccination documentation;
- Insurance documentation; or
- Other required documentation.
Kili Trails may provide general travel information or assistance with travel planning, but the client remains responsible for ensuring that their documentation meets the requirements of the relevant authorities.
Entry requirements may change without notice.
Travellers should verify requirements with the relevant embassy, immigration authority or official government source before departure.

Travel Insurance
Kili Trails strongly recommends that every traveller obtain comprehensive travel insurance appropriate to the nature and duration of the trip.
Depending on the policy, travel insurance may provide protection for:
- Trip cancellation;
- Medical emergencies;
- Emergency evacuation;
- Baggage loss or delay;
- Travel interruption;
- Personal liability;
- Missed connections; and
- Other travel-related risks.
Travel insurance is not automatically included in Kili Trails packages unless expressly stated in writing.
The client is responsible for determining whether their insurance provides adequate coverage for their particular trip and activities.
Comprehensive Cover, Strongly Recommended
Travel insurance is not automatically included in Kili Trails packages unless expressly stated in writing. We strongly recommend obtaining comprehensive cover appropriate to your trip.

Health, Medical and Accessibility Requirements
Clients should inform Kili Trails before booking about any requirement that may materially affect the safe or practical delivery of the trip.
This may include:
- Mobility requirements;
- Dietary requirements;
- Allergies;
- Medical conditions relevant to travel;
- Pregnancy;
- Physical limitations;
- Accessibility requirements; or
- Other special needs.
We will make reasonable efforts to accommodate disclosed requirements, subject to destination and supplier capabilities.
Travellers are responsible for obtaining appropriate medical advice before undertaking activities for which their health or fitness may be relevant.

Special Activities
Some travel experiences may involve physical activity or inherent risks, including:
- Wildlife viewing;
- Hiking;
- Mountain activities;
- Water activities;
- Walking safaris;
- Camping;
- Boat excursions;
- Cultural activities;
- Adventure activities; or
- Other outdoor experiences.
Clients should follow all safety instructions provided by Kili Trails, guides, drivers and activity operators.
Some activities may require separate waivers, medical declarations, age restrictions, fitness requirements or additional insurance.
CHAPTER 04
Traveller Responsibilities

Client Responsibilities
Clients are expected to:
- Provide accurate information
- Make payments on time
- Provide accurate travel and contact information
- Arrive at agreed meeting points on time
- Carry valid travel documents
- Follow reasonable instructions from guides and drivers
- Respect wildlife and local communities
- Respect accommodation and property
- Behave responsibly toward other travellers
- Inform Kili Trails promptly of problems or changes
- Take reasonable care of personal belongings
- Comply with applicable laws and regulations

Unacceptable Conduct
Kili Trails reserves the right to take reasonable action where a traveller’s behaviour:
- Endangers themselves or others;
- Seriously disrupts the trip;
- Involves harassment or abusive behaviour;
- Involves discrimination;
- Damages property;
- Involves unlawful activity;
- Seriously threatens staff, guides, drivers or other guests; or
- Violates applicable destination or supplier rules.
Depending on the circumstances, the client may be required to leave an activity, accommodation facility or other service without refund where permitted by law and the circumstances justify such action.
SECTION 28 · RESPONSIBLE & SUSTAINABLE TRAVEL

Kili Trails encourages travellers to explore East Africa responsibly. We believe tourism should create meaningful experiences while contributing positively to destinations and communities.

Personal Belongings
Clients are responsible for their personal belongings during travel.
We recommend that travellers:
- Keep valuable items secure;
- Avoid carrying unnecessary valuables;
- Use hotel safes where available;
- Keep passports and important documents secure;
- Maintain copies of important documents; and
- Follow reasonable security advice from guides and accommodation providers.
Kili Trails will take reasonable care in coordinating services but is not responsible for loss, theft or damage to personal belongings except where liability cannot lawfully be excluded.

Force Majeure
Kili Trails will not be responsible for failure or delay in providing services where the circumstances arise from events beyond our reasonable control.
Such circumstances may include:
- Natural disasters;
- Severe weather;
- Floods;
- Wildfires;
- Epidemics or pandemics;
- Civil unrest;
- War;
- Terrorism;
- Government action;
- Border closures;
- Strikes;
- Road closures;
- Transport disruptions;
- Major infrastructure failures;
- Security incidents;
- Wildlife-related emergencies;
- Changes in laws or regulations; or
- Other extraordinary circumstances beyond reasonable control.
Where such circumstances occur, we will make reasonable efforts to assist the client and identify practical alternatives.

Third-Party Suppliers
Many travel services are delivered by independent third-party suppliers.
These may include:
- Hotels;
- Lodges;
- Camps;
- Airlines;
- Transport companies;
- Drivers;
- Tour guides;
- Activity operators;
- Parks;
- Conservancies;
- Restaurants; and
- Other tourism providers.
Kili Trails carefully coordinates these services but cannot control every operational decision made independently by a third-party supplier.
Where a supplier fails to deliver a service, Kili Trails will make reasonable efforts to assist the client in resolving the issue and, where possible, securing an appropriate alternative.
CHAPTER 05
Support, Privacy & Website Use

Service Quality and Client Support
Our relationship with a client does not end when the booking is confirmed.
Where a client experiences a problem during a trip, we encourage them to contact Kili Trails as soon as reasonably possible.
Prompt reporting gives us the best opportunity to investigate and resolve an issue while the traveller is still at the destination.
We encourage clients to raise concerns with their guide, driver or designated Kili Trails contact immediately where doing so is safe and practical.

Complaints and Feedback
We value honest feedback.
If you are dissatisfied with any aspect of our service, please contact us as soon as possible.
A complaint should, where possible, include:
- Booking reference;
- Date of travel;
- Nature of the concern;
- Relevant supplier or service;
- Supporting information; and
- Desired resolution, where appropriate.
We will review complaints fairly and seek to resolve legitimate concerns promptly and professionally.
Client feedback may also be used to improve our services, subject to our Privacy Policy.
We're Here to Listen
Please raise any concern with us as soon as possible — prompt reporting gives us the best opportunity to help while you are still at the destination.

Photographs and Marketing
Kili Trails may, with appropriate permission, use photographs, reviews or testimonials supplied by clients for marketing or promotional purposes.
We will not assume that participation in a trip automatically gives us unrestricted rights to use an identifiable person’s image for commercial marketing.
Any use of personal data, photographs or testimonials will be handled in accordance with our Privacy Policy and applicable law.

Privacy and Personal Data
Kili Trails respects the privacy of clients and handles personal information responsibly.
Personal information may be required to:
- Prepare quotations;
- Make bookings;
- Arrange accommodation;
- Coordinate transportation;
- Arrange guides;
- Process payments;
- Communicate with clients;
- Provide customer support; and
- Meet legal or operational requirements.
Our processing of personal data is governed by our Privacy Policy, which forms part of our overall customer-service framework.
By using our services, you acknowledge that your personal information may need to be shared with relevant suppliers where reasonably necessary to deliver the services you have requested.

The Kili Trails website is intended to provide information about our company and services and to facilitate communication with prospective and existing clients.
While we aim to keep website information accurate and current, destination information, prices, availability, operating schedules and third-party information may change.
Website content should therefore not be treated as a guarantee that a particular service, price, attraction or accommodation option will remain available.
The specific terms applicable to a confirmed booking will take precedence over general website descriptions where there is a difference.

Unless otherwise stated, content published by Kili Trails, including:
- Logos;
- Brand elements;
- Text;
- Original photographs;
- Graphics;
- Website design;
- Marketing materials; and
- Other original content
is owned by or licensed to Kili Trails and may be protected by applicable intellectual-property laws.
You may not reproduce, modify, distribute or commercially exploit our protected content without appropriate permission.

Our website or communications may contain links to third-party websites.
These links may include:
- Hotels;
- Airlines;
- Government authorities;
- Tourism organizations;
- Payment providers;
- Attraction operators;
- Social-media platforms; and
- Other travel resources.
Kili Trails does not control third-party websites and is not responsible for their content, availability, security or privacy practices.
Clients should review the terms and privacy policies of third-party websites before using them.
CHAPTER 06
Family, Accessibility & Liability

Discounts and Special Offers
Promotional offers may be subject to specific conditions.
Unless otherwise stated:
- Offers are subject to availability;
- Offers may have specified travel periods;
- Offers may not be combined;
- Promotional prices may not apply to existing bookings;
- Offers may be withdrawn or changed where necessary; and
- Supplier restrictions may apply.
The specific conditions attached to an offer will apply where they differ from these general Terms.

Children and Family Travel
Families travelling with children are welcome.
Parents or guardians remain responsible for supervising children throughout the trip unless a specific supervised service has been expressly agreed.
Parents and guardians should inform Kili Trails about relevant requirements affecting the child’s comfort, safety, accessibility or dietary needs.
Age restrictions may apply to particular activities.

Accessibility and Special Assistance
We aim to make travel as inclusive and accessible as reasonably possible.
Clients requiring accessibility assistance should inform us as early as possible.
We will work with relevant suppliers to determine what can reasonably be provided.
However, accessibility standards and facilities vary considerably between destinations and suppliers.
Specific accessibility arrangements should therefore be confirmed in writing before booking.

Responsibility for Travel Decisions
Kili Trails provides travel planning and coordination based on information reasonably available to us.
Travellers remain responsible for making informed decisions about their travel, including whether a particular destination, activity, accommodation or itinerary is appropriate for their circumstances.
Where we identify a material concern relating to safety, accessibility or practical feasibility, we will communicate it to the client where reasonably possible.

Limitation of Liability
Kili Trails will provide its services with reasonable care and professionalism.
To the extent permitted by applicable law, Kili Trails will not be responsible for loss, damage, delay or additional expense resulting from:
- Circumstances outside our reasonable control;
- The acts or omissions of independent third-party suppliers;
- Inaccurate information provided by the client;
- Failure by the client to comply with travel requirements;
- Personal decisions or conduct of the traveller;
- Lost or stolen personal belongings;
- Missed flights or connections caused by circumstances outside our control;
- Changes imposed by authorities;
- Weather or natural conditions; or
- Wildlife behaviour.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

No Exclusion of Non-Excludable Rights
Nothing in these Terms is intended to remove, restrict or limit any legal right or remedy that cannot lawfully be excluded or limited under Kenyan law or any other applicable law.
Where a provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Indemnity
To the extent permitted by law, a client may be responsible for reasonable losses, costs or damage arising from the client’s:
- Deliberate misconduct;
- Negligence;
- Breach of these Terms;
- Damage to property;
- Violation of applicable laws; or
- Material failure to follow reasonable safety instructions.
This provision does not apply to the extent that the loss resulted from Kili Trails’ own negligence, unlawful conduct or other circumstances for which Kili Trails is legally responsible.

Insurance and Supplier Protection
Kili Trails seeks to operate responsibly and to engage appropriate service providers.

Licensing and Regulatory Compliance
Kili Trails operates within the applicable Kenyan tourism regulatory framework and will maintain the licences and approvals required for the tourism services it provides.
The Tourism Regulatory Authority identifies tour operators and travel agencies as regulated tourism enterprises and requires applicable tourism businesses to obtain and maintain the relevant licence.
Where applicable, Kili Trails will also work with appropriately licensed or qualified third-party suppliers.

Changes to These Terms
We may update these Terms from time to time to reflect:

- Changes in applicable law;

- Changes in our business practices.
The version applicable to a booking will generally be the version communicated or accepted at the time of booking, unless a change is required by law or agreed with the client.

Governing Law
These Terms are governed primarily by the laws of Kenya.
Any dispute arising in connection with these Terms should first be addressed through good-faith communication between the client and Kili Trails.
Where a dispute cannot be resolved through reasonable discussion, the parties may pursue the appropriate dispute-resolution mechanism or competent court or tribunal in accordance with applicable Kenyan law.
Nothing in these Terms prevents a client from exercising any mandatory legal right available to them.
These Terms are governed primarily by the laws of Kenya.

Dispute Resolution
Kili Trails believes that most disputes can be resolved through open communication.
Where a concern arises, the parties should first seek to resolve it through:
- Direct communication with the Kili Trails team;
- Review by a responsible manager or designated representative;
- Good-faith negotiation; and
- Where appropriate, mediation or another lawful dispute-resolution mechanism.
If the matter remains unresolved, either party may pursue any remedy available under applicable law.

Entire Agreement
The confirmed booking documentation, applicable quotation, itinerary, payment terms and these Terms collectively form the agreement between Kili Trails and the client in relation to the relevant services, subject to applicable law.
Where a specific written booking condition conflicts with a general provision of these Terms, the specific condition applicable to that booking will prevail to the extent of the inconsistency.

Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be modified or removed only to the extent necessary, and the remaining provisions will continue in effect.

No Waiver
If Kili Trails does not immediately enforce a provision of these Terms, that does not mean that we have permanently waived our right to enforce it later.
